Please read these booking terms before reserving an activity on topcabotours.com. They explain how reservations, online deposits, cancellations, schedule changes, and participation work. The details shown for a specific tour are also part of that reservation.
Check the activity details before paying
Tour schedules, prices, participant limits, pickup areas, inclusions, entrance fees, safety requirements, and optional extras are not the same for every activity. Review the selected tour page and booking form carefully before submitting payment.
When information on a tour page or booking form is more specific than this document, the tour-specific information applies to that reservation unless Mexican law requires a different result.
The person submitting a group reservation is responsible for entering accurate information and sharing the confirmation, cancellation rules, meeting instructions, and safety requirements with every participant. A parent or legal guardian must approve a reservation for a minor.
When a reservation becomes confirmed
Submitting the booking form and paying the requested deposit creates a reservation request. TOPCABOTOURS will then verify availability and send the customer the confirmation and final instructions. A requested date or time should not be treated as confirmed until that message is sent.
If the requested activity cannot be confirmed, TOPCABOTOURS will offer another available option. If the customer does not accept an available alternative, TOPCABOTOURS will refund the online deposit paid for that reservation in full.
Customers should review their confirmation as soon as it arrives and report incorrect names, dates, participant numbers, contact information, or selected options promptly. Requested corrections remain subject to availability.
Prices and payments
Unless another currency is clearly identified, website prices are displayed in USD. The tour page and reservation form indicate whether a price applies per person, per vehicle, or per group.
Most activities are reserved by paying a deposit online. The booking form displays the deposit and all other amounts associated with the selected option. Park or entrance fees, private transportation, collision or damage protection, gratuities, photographs, souvenirs, and personal purchases are included only when the page specifically says they are included.
A bank or payment provider may impose its own conversion or international-transaction charge. Those charges are not collected by TOPCABOTOURS.
Submitting payment authorizes the amount displayed at checkout. Customers receive an electronic record of the transaction. Anyone who believes a charge is incorrect should contact TOPCABOTOURS promptly so the reservation and payment records can be reviewed. This request does not restrict any lawful bank, card-network, PROFECO, or consumer-protection right.
Private promotional codes
A private code must be entered and accepted before checkout is completed. Unless the offer expressly says otherwise, the percentage applies only to the online deposit. It does not reduce entrance or park fees, private transportation, optional protection, or other separately charged items.
Private deposit codes cannot be combined with one another, exchanged for cash, or applied after a completed payment. Availability may be limited by tour, reservation form, or promotional period.
Changing or cancelling a reservation
The following rules apply unless the selected activity clearly displays a different cancellation policy:

The 24-hour period is measured using the local time at the activity location. Cancellation and change requests may be sent by email, WhatsApp, or telephone. Include the reservation name, activity, date, and confirmation information. A request is considered received when it reaches TOPCABOTOURS.
A date, time, pickup, participant, or activity change is not guaranteed and may affect availability or price. Missing a confirmed pickup or activity because of late arrival does not qualify for a refund.
Weather, wildlife, and itinerary adjustments
Outdoor activities may be affected by wind, waves, storms, road conditions, protected-area rules, animal welfare, mechanical problems, safety concerns, or government restrictions. These circumstances may require a different time, route, pickup, sequence, vessel, vehicle, equipment setup, or planned stop.
Wild animals determine their own movement and behavior. Seeing or interacting with orcas, whales, mobula rays, sea lions, or any other species is never guaranteed. Access to beaches, reefs, protected areas, and wildlife zones may also change with season, permits, conservation rules, and sea conditions.
If an activity is cancelled or cannot be supplied as confirmed, TOPCABOTOURS will communicate the available solution. Depending on the situation and the activity’s policy, the customer may be offered a new date, a comparable activity, an accepted credit, or a refund. Any remedy required by Mexican consumer or tourism law remains available.
Pickup and punctuality
Pickup is provided only when the selected activity says it is included and only within the stated service area. The pickup time may be earlier than the activity’s departure time and is sent with the final instructions.
A reservation made shortly before departure may require the customer to reach the meeting point independently unless pickup is expressly confirmed.
Customers must be ready at the confirmed location and time. A vehicle, boat, guide, or group may be unable to wait for a late participant.
Participation requirements
Some activities have rules involving age, height, weight, driving or riding experience, swimming ability, driver’s licenses, footwear, protective equipment, pregnancy, recent surgery, heart or back conditions, medication, or alcohol and drug use. The requirements displayed for the selected activity must be reviewed before booking.
Contact TOPCABOTOURS before reserving when a participant has a health consideration, disability, or accessibility need that could affect safe participation. Reasonable requests will be reviewed, but an accommodation cannot be promised when it is incompatible with the location, equipment, or nature of the activity.
Participation may be refused or stopped for a genuine safety reason, including failure to meet a disclosed requirement, intoxication, refusal to use safety equipment, disregard of instructions, abusive conduct, or behavior that puts people, animals, property, or the environment at risk. Any refund will depend on the circumstances, the activity’s published policy, and applicable law.
Understanding adventure-activity risks
Activities such as ATV or RZR driving, horseback or camel riding, boating, snorkeling, swimming, and wildlife excursions involve risks that cannot be completely removed. Examples include vehicle or vessel movement, rough terrain, sand, waves, currents, heat, sun exposure, slips, falls, animal behavior, remote locations, and delayed access to medical assistance.
Participants agree to follow guide instructions and use required safety equipment. An additional safety acknowledgment may be presented for a particular activity. Nothing in this section, or in an activity-specific acknowledgment, removes a consumer right or legal responsibility that Mexican law does not permit the parties to exclude.
Respectful behavior and property
Participants must follow applicable laws, safety directions, protected-area and environmental rules, and reasonable activity instructions. Respect for staff, other guests, local communities, wildlife, equipment, and property is required.
Where permitted by law, a participant is responsible for damage directly caused by intentional conduct, misuse, or refusal to follow instructions. Collision, equipment, or damage protection applies only when it is specifically described and purchased or required for the selected activity.
Included and unused items
An item is included only when it appears in the selected activity description or confirmation. Depending on the reservation, transportation outside the stated area, entrance fees, protection plans, gratuities, photographs, souvenirs, meals, drinks, and personal expenses may cost extra.
Subject to applicable law and the activity’s specific policy, no refund is due for a confirmed portion of an activity that a participant voluntarily declines or misses after it has been made available.
Serious events outside reasonable control
Severe weather, hurricane, fire, flood, earthquake, epidemic, government action, protected-area closure, strike, civil disturbance, or a major transportation interruption may prevent safe or lawful performance.
TOPCABOTOURS may communicate necessary changes or cancellation of an affected activity. Customers will be informed of a material change as soon as reasonably possible, and the available solution will be determined under the activity’s policy and applicable law. Legally protected refund and consumer rights are not cancelled by this section.
Booking information and messages
Reservation information is used to process payment, organize the selected activity, and communicate confirmation or operational details. Information is handled in accordance with applicable privacy law.
Operational messages may be sent to the email address, telephone number, SMS number, or WhatsApp account provided with the reservation. Promotional messages will be handled separately and may be declined where required by law.
These booking terms do not grant permission to use a participant’s photograph or video for advertising. Any promotional use requiring consent will be handled separately.

TOPCABOTOURS will review the reservation records and respond as promptly as reasonably possible. A customer may also seek assistance from PROFECO or another Mexican authority or court with lawful jurisdiction. No part of this document asks a customer to surrender a non-waivable consumer right.
Legal framework and document updates
Reservations made on the website are subject to applicable Mexican law, including federal consumer, tourism, privacy, and electronic-commerce rules and applicable law in Baja California Sur.
The terms presented when a customer books apply to that reservation. A later revision normally applies only to future reservations. A confirmed reservation will not be materially changed without notice and, when required, customer agreement, except when a change is required by law or is reasonably necessary for immediate safety.
The reservation agreement consists of this document, the selected activity page, the completed booking form, the confirmation, and activity-specific conditions disclosed before payment. If one provision cannot be enforced, the rest remains effective to the extent allowed by law.
